Maine Announces Opening of Public Comment Period for its PFAS Reporting Law
The Maine Department of Environmental Protection (DEP) announced on February 14, 2023 that it is now accepting public comments for the state’s PFAS reporting draft rule, which was approved by the Maine Board of Environmental Protection on January 19, 2023. The rule provides additional guidance on the notification requirements and sales prohibitions for products and product components containing intentionally added PFAS. Comments may be submitted by emailing rulecomments.dep@maine.gov with “Comment on Chapter 90: Products Containing Perfluoroalkyl and Polyfluoroalkyl Substances” as the subject line. A public hearing is scheduled for April 20, 2023 at 9 a.m. at the Augusta Civic Center. As we noted in our previous article, DEP indicated that it intends to allow for virtual participation, although the virtual participation format is currently unclear. The public comment period will close on May 19, 2023 at 5 p.m.
