FDA Extends Comment Period for Proposed Post-Market Assessment of Chemicals in Food

FDA Building

The U.S. Food and Drug Administration (FDA) has extended the comment period for obtaining feedback from the public about the Agency’s approaches to systematic post-market assessment of chemicals in food. The comment period, which was originally set to close on December 6, 2024, has been extended to January 21, 2025.

FDA granted the extension in response to a request from the Food & Beverage Issue Alliance (FBIA), which is comprised of 45 U.S.-based food and beverage trade associations. In a letter to FDA’s Deputy Commissioner of Foods, Jim Jones, FBIA stated that additional time is needed to “fully engage our membership, gather comprehensive feedback, and submit detailed, thoughtful comments that will better support the FDA’s objectives in this critical area.”

The comment period follows a public meeting that FDA held on September 25, 2024, to explain the Agency’s current reasoning on the topic and solicit input on the Agency’s proposed enhanced systematic process for post-market assessment of chemicals in food. For more information on that meeting, see the Packaginglaw.com article, FDA Explains Proposed Process for Post-Market Assessment of Chemicals in Food.

Comments may be submitted in writing or electronically at regulations.gov and must include the Docket No. FDA-2024-N-3609 for “Development of an Enhanced Systematic Process for the Food and Drug Administration's Post-Market Assessment of Chemicals in Food; Public Meeting; Extension of the Comment Period.”
