California Extends Comment Period for Proposed Rulemaking on Prop 65 Warning Requirements

On October 27, 2023, California’s Office of Environmental Health Hazard Assessment (OEHHA) issued a Proposed Rulemaking to amend the warning requirements under Proposition 65 (otherwise known as the Safe Drinking Water and Toxic Enforcement Act of 1986).  The proposal, if enacted, would revise both the standard long-form and short-form warning requirements, as well as the warning requirements for products purchased from the internet or from catalogs.  More information on the proposal can be found here.

While the comment period was initially supposed to end on December 20, 2023, OEHHA announced that the comment period has been extended until January 3, 2024.  You can submit a comment on the proposed rulemaking here.
